These Terms of Service ("Terms") govern your access to and use of:

The Services are owned and operated by PumpServicePro.com ("Company," "we," "us," or "our").
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
You must be at least 18 years old, have authority to bind your business (if registering as a company), and provide accurate account information. You are responsible for maintaining the confidentiality of your login credentials.
The Services provide web-based software tools for pump service management, pump efficiency testing and reporting, job tracking, team member management, customer portals, business directory listings, optional integrations (Google, Stripe, QuickBooks), and optional SMS / text messaging for customer-care notifications (job updates, estimates, invoices, appointments), subject to consent and our Privacy Policy (https://pumpservicepro.com/privacy-policy.html). We may update, modify, or discontinue features at any time.
To access certain features, you must create an account. You agree to provide accurate and complete information, maintain current contact details, and accept responsibility for activity under your account. You are responsible for all team members added to your subscription.
If you choose to sign in via Google, you authorize us to access basic account information (email, name, profile). We comply with Google API Services User Data Policy and only request minimum required scopes. We do not access Gmail, Drive, or other Google data unless explicitly authorized.
If you connect third-party services (e.g., QuickBooks), you authorize data synchronization and are responsible for reviewing synced data. We are not responsible for accounting errors resulting from incorrect inputs. We may suspend integrations if required by third-party policy changes.
Certain features require a paid subscription. By subscribing, you agree to provide valid payment information, that charges will recur automatically unless canceled, and that pricing may change with notice. Free trials, if offered, convert automatically to paid plans unless canceled prior to expiration. Failure to pay may result in suspension or termination. All payments are processed through Stripe. We do not store full credit card information.
You retain ownership of pump test data, reports, uploaded documents, and customer information entered into the system. You grant us a limited license to store, process, transmit, and display your data solely to provide the Services. You are responsible for accuracy of submitted data, legal right to upload customer information, and compliance with applicable regulations, including obtaining any required SMS consent before messaging customers.

Businesses listed in the directory represent that listing information is accurate, grant us permission to display business information, and agree not to submit misleading or fraudulent listings. We reserve the right to edit or remove listings at our discretion.
You agree not to violate any laws; upload malicious code; attempt to hack, reverse engineer, or disrupt services; use the Services for fraudulent activity; impersonate others; upload confidential data without authorization; or send SMS without required consent. Violation may result in immediate termination.
We implement commercially reasonable security measures. However, no system is completely secure; you use the Services at your own risk; and we are not liable for unauthorized access beyond our reasonable control.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee continuous uptime, error-free operation, or regulatory compliance for your specific business. Pump efficiency reports are informational tools only.
To the maximum extent permitted by law, our total liability shall not exceed the amount paid by you in the twelve (12) months preceding the claim. We are not liable for lost profits, lost business opportunities, indirect or consequential damages, data loss, customer disputes, or regulatory fines resulting from your misuse.
You agree to indemnify and hold harmless the Company from claims arising out of your misuse of the Services, your data submissions, violations of law, and disputes between you and your customers.
We may suspend or terminate your account if you violate these Terms, fail to pay subscription fees, or as required by law. You may cancel at any time. Termination does not relieve outstanding payment obligations.
All software, branding, and content are owned by the Company. You may not copy, resell, reverse engineer, or republish without written consent.
Upon account termination, you may request data export (if available). We may delete account data after a reasonable retention period. Some records may be retained for legal compliance.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Venue shall lie in Tulare County, California.
Disputes shall first be attempted to be resolved informally. If unresolved, disputes may be resolved through binding arbitration or state or federal court jurisdiction.
We may modify these Terms at any time. Continued use of the Services after updates constitutes acceptance.
